TERMS AND CONDITIONS

By proceeding with a booking, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

These Terms and Conditions (“Terms”) govern all bookings and services provided by The Legendary Santa Claus (“Santa,” “we,” “our,” “us”). By making a booking, you agree to be bound by the following Terms:

1. DEFINITIONS

1.1 Client: The individual, organisation, or entity making the booking.
1.2 Event: The appearance, performance, or service provided by The Legendary Santa Claus at the Client’s specified venue or online platform.

2. BOOKINGS

2.1 Booking Confirmation: Bookings are confirmed only upon receipt of a signed agreement or written confirmation (via email or other agreed communication) from both parties.
2.2 Information Provided: The Client is responsible for providing accurate and complete information regarding the Event (date, time, location, duration, and any special requirements).

3. FEES, TRAVEL & ACCOMMODATION

3.1 Fees: Our fees reflect the high standard of service and unique portrayal of Santa. A full quote will be provided upon request or after the necessary details are discussed.
3.2 Travel & Accommodation: Where required, Santa will usually organise all travel and accommodation arrangements. The costs for these arrangements will be included in the final invoice or total amount due.
3.3 Payment Terms: Payment details (deposit amount, final payment date, etc.) will be outlined in your quote or booking agreement. Payment must be made in accordance with these details to secure Santa’s services.

4. DEPOSIT & FINAL PAYMENT

4.1 Deposit: A non-refundable deposit may be required at the time of booking. This deposit confirms your date and Santa’s availability.
4.2 Final Payment: The remaining balance (including any additional agreed expenses) must be paid by the date specified in the invoice or booking agreement. Failure to remit payment in full by the specified date may result in cancellation of the booking.

5. CANCELLATIONS & REFUNDS

5.1 Client Cancellations: If the Client cancels the booking, any deposit paid is non-refundable. Cancellation fees or refunds of additional payments (beyond the deposit) will be detailed in the booking agreement.
5.2 Force Majeure: In the event of circumstances beyond our control (including but not limited to adverse weather conditions, travel disruptions, illness, or pandemic restrictions), we will make all reasonable efforts to fulfil the booking or reschedule. However, we cannot be held liable for non-performance or required adjustments due to such circumstances.
5.3 Santa’s Cancellation: In the rare instance that we need to cancel a confirmed booking, we will provide a full refund of any payments received or offer an alternative arrangement, as mutually agreed with the Client.

6. CONDUCT & REQUIREMENTS

6.1 Suitable Environment: The Client is responsible for providing a safe, respectful, and appropriate environment for the Event. This includes adequate space, lighting, and, if necessary, suitable shelter from the elements.
6.2 Client Conduct: The Client agrees to ensure that guests or participants treat Santa with courtesy and respect. Abusive or threatening behaviour will result in the immediate termination of the performance without refund.
6.3 Performance Length & Breaks: Event timings and any required breaks for Santa will be agreed upon in advance. Overrunning of the booked schedule may incur additional fees.

7. LIABILITY & INSURANCE

7.1 Public Liability Insurance: The Legendary Santa Claus holds full public liability insurance applicable to the services provided. Evidence of coverage can be provided upon request.
7.2 Damage & Loss: The Client is responsible for any property damage, theft, or losses caused by attendees or guests during the Event. We are not liable for any such damage or loss.

8. PHOTOGRAPHY & MEDIA

8.1 Usage Rights: We may take or permit photos or videos during the Event for promotional purposes. If you do not wish for media featuring you or your guests to be used, please let us know in writing prior to the Event.
8.2 Client Photos: Clients are welcome to take photos or videos of Santa for personal use. Please note that the commercial use of any media featuring The Legendary Santa Claus requires prior written consent.

9. PRIVACY & DATA PROTECTION

9.1 Personal Data: Any personal information provided by the Client will be used solely for the purpose of booking and delivering Santa’s services.
9.2 Consent: By submitting personal data, you consent to its use as described in these Terms. No data will be shared with third parties unless strictly necessary for fulfilling the services (e.g., travel bookings).

10. GOVERNING LAW & DISPUTES

10.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Scotland. However, as services are provided throughout the UK, the parties agree to comply with any applicable laws of England, Wales, or Scotland.
10.2 Dispute Resolution: In the event of any dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies.

11. ENTIRE AGREEMENT

11.1 No Other Terms: These Terms, together with any written booking agreement or contract, constitute the entire agreement between the Client and The Legendary Santa Claus.
11.2 Amendments: Any changes or amendments to these Terms must be agreed upon in writing by both parties.
